These Terms and Conditions govern your use of the BTIT Online Shop, including broadband services, open-source software, and online storage solutions. By purchasing our products or services, you agree to abide by these terms. Please read them carefully.
1. Broadband Services
Our broadband services are provided via fibre and include the option to receive physical hardware (e.g., WiFi router). By signing up for BTIT broadband, you agree to the following:
a. Service Availability
BTIT’s broadband services are dependent on the availability of fibre in your location. We will confirm whether your address is eligible for fibre before service activation.
b. Hardware
If required, a WiFi router will be shipped to you:
- Shipping Fees: Standard shipping costs apply (see our Shipping Policy).
- Router Setup: You are responsible for setting up the router based on the instructions provided.
- Ownership: The router remains your property after purchase. However, if any hardware is provided on a rental basis, it must be returned if you cancel the service.
c. Plan Specifics
- Your plan details, including data allowance, speed, and monthly fees, will be provided during sign-up.
- Any overuse or abuse of the network, including actions that cause interference or degrade the experience of other users, may result in suspension or termination of services.
d. Cancellation
You may cancel your broadband service at any time with a 30-day notice. Fees may apply if cancelling within a minimum contract period.
e. Network Management
BTIT uses traffic management practices to ensure fair use and consistent service quality for all customers. These may include temporary speed restrictions in cases of excessive data usage.
2. Open-Source Software Licenses and Guarantees
Many of the software solutions provided by BTIT are based on open-source platforms, including but not limited to OrangeHRM, SuiteCRM, and GLPi. These solutions come with their respective open-source licenses. By using our services, you acknowledge and accept the terms of these licenses, including the following key points:
a. No Warranty
Open-source software is provided "as is" with no express or implied warranties. While BTIT will make every effort to support and maintain these solutions, we cannot guarantee that the software will function without issues or interruptions.
b. Liability
BTIT is not liable for any loss or damages arising from the use of open-source software, including data loss, service interruptions, or software bugs. Use of such software is at your own risk.
c. Licenses
The terms and conditions of the applicable open-source license (such as the GNU General Public License) govern your use of these software solutions. We encourage you to read the full license agreements included with each product.
3. Online Storage Service
BTIT provides online storage services hosted in New Zealand, with geo-fencing for in-country access and a focus on high performance and resilience. However, by using this service, you acknowledge and agree to the following:
a. Indemnity for Data Loss
While BTIT employs rigorous security measures and data protection protocols, we cannot guarantee that your data will be immune to all risks, such as system failures, unauthorised access, or unforeseen disasters. You agree to indemnify and hold BTIT harmless from any data loss, corruption, or unauthorised access beyond our control, despite our best efforts to secure and protect your information.
b. Data Redundancy
BTIT’s online storage includes distributed storage maintaining three copies of your data in real-time and daily offsite backups for added resilience. However, we recommend that customers keep their own backups of critical data.
c. Limited Liability
BTIT is not responsible for any direct or indirect losses, damages, or disruptions caused by third-party systems, failures of data transmission, or force majeure events that affect the operation of our online storage services.
4. Payment Terms
All fees for services, whether broadband, software, or storage solutions, must be paid in accordance with the billing schedule provided at sign-up. Failure to pay on time may result in suspension or termination of services. Any outstanding balance may incur additional fees.
5. Fair Use Policy
BTIT applies a fair use policy to ensure equitable access to services for all customers. Abuse of any service, including excessive bandwidth consumption, unauthorised sharing of resources, or attempts to disrupt or misuse the network, may result in throttling, suspension, or termination of services.
6. Intellectual Property
All content, materials, software, and products made available through the BTIT Online Shop are the intellectual property of BTIT or its licensors. You may not use, copy, modify, or distribute any materials without prior written permission.
7. Indemnity
You agree to indemnify, defend, and hold harmless BTIT, its affiliates, employees, and agents from any and all claims, damages, liabilities, costs, and expenses, including legal fees, arising from your use of our services, breach of these terms, or violation of the rights of others.
8. Governing Law
These Terms and Conditions are governed by the laws of New Zealand. You agree to submit to the jurisdiction of the courts of New Zealand in any disputes arising out of your use of BTIT's products and services.
9. Amendments
BTIT reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and your continued use of the website and services constitutes acceptance of the revised terms.
